Search System™ Software and Database License: By using our software and database, the purchaser agrees to the license terms as set forth below.
Grant of License: Custom Databanks, Inc. permits you to use one copy of the Search System Database™ and grants you a non-exclusive, nontransferable limited license to use this software and data on a single personal computer. The Search System™ is ‘in use’ on a computer when it is loaded into temporary memory (i.e. RAM) or installed into permanent memory (e.g. hard disk, CD-ROM or other storage device) of that computer. However, installation on a network server for the sole purpose of internal distribution shall not constitute “use’ for which a separate license is required, provided you have a separate license for each terminal to which the Search System™ is distributed.
- Consumer License: You have purchased a license to use this software and its data on one personal computer at a time.
- Company (outplacement, resume writers, career counselors, etc.) License: You have purchased a license to use this software and its data on one personal computer in one office for the clients of that office only. You may not re-sell the data to any other company either directly or as part of a resume distribution service.
Copyright Information: This software, its data and any documentation are protected by U.S. copyright laws and international copyright treaties. By using the Search System™, you acknowledge that you have read, understood and agree to be bound by all the provisions of this license. Software is like any other copyrighted material, except that you may make one copy of the software solely for archival purposes.
Other restrictions: You may not make any changes or modifications to the Search System™ software and data. You may not delete any of the files contained in the software and you may not decompile, disassemble, or otherwise reverse engineer the software or data. The software and data are not for sale, and you may not sub-license, rent, lend, lease, donate, sell, load, pledge, transfer or distribute on a temporary or permanent basis the original copy or backup copy or any of the data distributed with the software to another person or company.
Title: Title to this software and the data which it makes available is retained by Custom Databanks, Inc. and is not transferred to any user by grant of a license as provided. YOU MAY NOT SELL OR FURTHER LICENSE THIS SOFTWARE OR ITS DATA TO ANY OTHER PERSON OR ORGANIZATION WITHOUT THE EXPRESS WRITTEN PERMISSION OF CUSTOM DATABANKS, INC.
Data Accuracy: The data supplied by this software has been compiled by surveying the companies in the database by phone and by mail and on the internet. Data are updated on a continuing basis, but frequency is not assured. Because of the possibility of error by its sources, Custom Databanks, Inc. does not warrant for the accuracy, errors, omissions or adverse consequences to anyone resulting from use or reliance upon such data. No endorsement, rating or qualification of any company is implied by its inclusion in the data supplied by this software.
Limitation of Liability and Warranty: Custom Databanks, Inc. warrants the medium upon which this software and its data are provided against defective materials and workmanship under normal use for a period of 30 days from date of receipt. In no event, however, will Custom Databanks, Inc. be liable for any direct or indirect damages or loss of profits arising out of inability to use this software and its data. Your exclusive recourse and our exclusive responsibility will be replacement of the medium on a claim made within or promptly after the 30-day warranty period.
